Any contracts must be made as explicit as possible in order to avoid gharar and injustice to any of the parties. A clause in the contract allowing a change in liability beyond the control of the liable party would be unjust. The validity of the contract requires that its motivating and underlying cause should be according to the requirements of the shariah. It is pointed out that to nip evil in the bud, Islam seeks to block all those channels that eventually lead to injustice.
