In recognizing the intricacies of Islamic law, knowledge of the history of its growth and construction is very important. This fact, however, has not received due attention in the tradition of the study of Islamic Law in our country. More focus has been made in understanding the texts of the law separately from the background of the law itself fatwa by the jurists concerned. As a result, the understanding of the law is rather superficial, in addition to the emergence of various legal holdings that are actually not in accordance with the situation and time.
